The UK hacker, who the US is trying to label a terrorist, is going through his second last chance to avoid extradition.

Gary McKinnon hacked into various US defence establishments desperate to find hidden proof of UFOs. The US government was not impressed with this and have been trying to get him to a US court which will lock him up for years.

McKinnon's defence team have tried appeal after appeal but scored a success when it was revealed he was suffering from Asperger's syndrome, which is a mild form of Autism.

Lawyers for Gary McKinnon, from Wood Green, north London, say he would be at real risk of psychosis or suicide if removed to America. Appeal judges Lord Justice Stanley Burnton and Mr Justice Wilkie, will be asked to rule on whether the health risk is too great to allow removal.

While he has admitted carrying out the hack, his chance of getting a fair sentence in the US is remote. The US government wants him to be tried as a terrorist and locked up for life. However it is fairly clear that anyone who has hand anything to do with McKinnon is he is not a terrorist. If he were tried in any civilised country he probably would not even get a jail sentence.

US government officials told him that if he pleaded guilty in the US he would get “only four years” in jail. However if he didn't do what he was told he could be locked up forever.
