Nvidia's mobile GPU mess ends up in court

 

Nvidia, Hewlett Packard and Dell are on the fast track to a New York courtroom, thanks to a class action concerning Nvidia's mobile GPU issue.

The companies are accused of offering only a software solution to the issue which adversely affects performance and battery life of affected machines. Both Dell and HP offered a software fix which forced the GPU cooler to run at higher speeds. No compensation or replacements was offered to consumers with defective units.

While the fix could be considered successful from a technological standpoint, it must be noted that consumers did indeed end up with louder machines and less performance, without any form of compensation.

On the West coast, a second class action has been filed in California. It alleges Nvidia CEO Jen-Hsun Huang and Marvin Burkett made misleading statements and omissions about the defective GPU issue.

Both of them were aware of the issue as far back as November 2007, the filing alleges, but failed to inform the public for eight months. The plaintiffs accuse Huang and Burkett for a market capitalization slump of $3 billion, caused by the issue, and claim they suffered substantial damages as a result.
