German court quashes stolen goods conviction

A German man, who bought stolen goods online,
has had a receiving conviction quashed on appeal.

The
move would be a great relief to eBay which could have seen a number of its customers convicted if the law was read in a similar way. The 47-year-old software engineer claimed he had not known that a car navigation system he bought over eBay two years ago had been
stolen.

He had bought the navigation system, which was
advertised as "brand new," for less than a third of its usual
price. The man had been fined 1,200 euros after the lower court
had thought that the low price should have been a tip off that the
device was stolen.
