US jury rules

A US jury has ruled that IT services and consulting firm Cognizant engaged in discriminatory practices against non-Indian employees and should be liable for punitive damages to compensate those affected.

This verdict follows the company’s unsuccessful attempt to convince a Los Angeles federal judge to dismiss a 2017 job bias class-action lawsuit, which previously resulted in a hung jury.

A spokesperson for Cognizant expressed disappointment with the jury’s decision and indicated that the company intends to appeal.

“We provide equal employment opportunities for all employees and have built a diverse and inclusive workplace that promotes a culture of belonging in which all employees feel valued, are engaged, and have the opportunity to develop and succeed." the company said.

In July, Bloomberg News reported that the Teaneck, New Jersey-based company was among several outsourcing firms exploiting loopholes in the H1-B visa lottery system. Cognizant defended its practices, asserting full compliance with US visa laws. The company also noted that it has increased its US hiring and reduced reliance on the H1-B programme in recent years.
